Please read these Terms of Service (“Terms”, “ToS”) carefully before using the website boffinfx.com (the “Site”), any mobile applications we may offer, or purchasing any products or services from Boffin FX (collectively, the “Services”).

These Terms constitute a legally binding agreement between you (“you”, “User”, “customer”) and Boffin FX (“we”, “us”, “our”, “Boffin FX”), a sole proprietorship / business based in Nevada, United States, located at 3055 Saint Rose Pkwy #777372, Henderson, NV 89052.

By accessing or using the Site, placing an order, or otherwise interacting with our Services, you agree to be bound by these Terms. If you do not agree, you must not use the Site or purchase from us.

1. Use of the Site

• You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site or make purchases.
• You agree to use the Site only for lawful purposes and in accordance with these Terms.
• We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes (browsing, learning about products, placing orders).
• You may not:
• Copy, reproduce, modify, distribute, display, or create derivative works from any content without our written permission.
• Use any robot, spider, scraper, or other automated means to access the Site.
• Attempt to interfere with the proper working of the Site.
• Use the Site to transmit viruses, malware, or harmful code.

2. Products and Orders

• All products offered on boffinfx.com are guitar effects pedals, upgrades, components, and related accessories designed for musical instruments (primarily electric guitars).
• Product descriptions, images, specifications, and pricing are provided in good faith but may contain errors. We reserve the right to correct any errors and to update information at any time without notice.
• All orders are subject to availability. We may refuse or cancel any order (even after confirmation) if a product is out of stock, if there is a pricing error, or for any other legitimate reason.
• Prices are in United States Dollars (USD) and do not include applicable sales tax, duties, customs fees, or shipping charges unless explicitly stated.
• Title to products passes to you upon shipment; risk of loss passes upon delivery to the carrier.

3. Payment

• We accept major credit/debit cards and any other payment methods displayed at checkout.
• By providing payment information, you represent that you are authorized to use that method.
• You agree to pay all charges incurred, including taxes and shipping.
• We may use third-party payment processors; their terms also apply to your payment.

4. Shipping & Delivery

• Shipping times and costs are estimated only and displayed at checkout.
• We ship primarily within the United States; international shipping may be available but is subject to additional fees, duties, and customs clearance (which are your responsibility).
• We are not liable for delays caused by carriers, customs, incorrect addresses, or force majeure events.

5. Returns, Refunds & Warranty

• Please refer to our separate Refund Policy and Warranty pages on boffinfx.com (links usually found in the footer).
• In general:
• Many boutique/handmade/small-batch effects have limited or no return policy except for manufacturing defects.
• Defective products may be eligible for repair, replacement, or refund under our warranty terms (typically 1–5 years depending on the product—check product page).
• Return shipping is usually your responsibility unless the item is defective and we pre-authorize the return.

6. Intellectual Property

• All content on the Site (text, graphics, logos, images, audio, video, product designs, pedal layouts, names like “TeleBooster”, “Da Fuzz”, etc.) is owned by Boffin FX or our licensors and protected by U.S. and international copyright, trademark, and other laws.
• You may not use our trademarks, product names, or imitate our pedal designs for commercial purposes without written permission.

7. Limitation of Liability

To the fullest extent permitted by law:

• THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE, PURCHASE OF PRODUCTS, OR ANY RELATED MATTER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

8. Indemnification

You agree to indemnify, defend, and hold harmless Boffin FX, its owner(s), employees, and agents from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your misuse of the Site/products, or your infringement of any third-party rights.

9. Governing Law & Dispute Resolution

• These Terms are governed by the laws of the State of Nevada, United States, without regard to conflict of law principles.
• Any disputes shall be resolved exclusively in the state or federal courts located in Clark County, Nevada.
• You waive any objection to venue or inconvenience of forum.

10. Changes to Terms

We may update these Terms at any time. The updated version will be posted here with a revised “Last Updated” date. Continued use of the Site after changes constitutes acceptance of the new Terms.
